Let’s say I’m married to someone of the same- sex in Belgium (which is legal). But what happens if I move to another country for instance like Poland or Bulgaria which have limited LGBT rights, no same-sex marriage etc. So, if you were to immigrate to those countries who have banned same-sex marriage constitutionally while the EU explicitly says that every citizen have the same rights, how would queer people benefit citizenship or even acquire it if they’re married in another country while their partner is from Poland who was married in Belgium? What about spouse rights in those countries who have no same sex marriage?
I’m seeing an exact loophole just like how United States had this very problem until they legalised it nationwide in 2015.
Would you guys support if the EU ruled that same-sex is a human right therefore by de-facto in the constitution EU-wide.
